Whistleblowers have a reason to rejoice with the new Employment Appeal Tribunal (EAT) judgment in a case against BP that has upheld the interests of whistleblowers from adversities like reprisals from present, prospective and future employers.
The case was filed by Mr Paul Elstone who was an employee of Petrotechnics for a period of two years and four months from February 2006. He monitored the processes related to safety for several clients including BP. After he made disclosures about Petrotechnics to BP, he was dismissed by Petrotechnics and hired by BP. However, after some time, BP communicated their inability in allowing him to continue with his job because of the previous disclosures he had made. The final hearing about the disclosures and the mode of dismissal are yet to happen.
The primary question raised in the appeal was whether an employee who felt that he was being punished by the present employer for making protected disclosure to a previous employee could seek protection of Section 47b of the Employment Rights Act 1996. The court opined that such a claim was permissible, according to interpretation of the statute.
The judgment comes as a relief for whistleblowers, who would be worried about the impact of disclosing misdeeds on their career at a subsequent point of time. It provides clarification as well as protection to such individuals.
